1. Who We Are

This website (“Site”) is owned and operated by Ava Bock, a U.S.-based fine artist.
References to “we,” “us,” and “our” refer to Ava Bock Art.

2. Intellectual Property & Copyright

All artwork, photographs, videos, text, graphics, and digital files on this Site are the exclusive property of Ava Bock, unless otherwise noted.

This includes:

  • drawings

  • paintings

  • sculptures

  • relief works

  • digital images

  • product photos

  • process images

  • videos

  • blog content

  • downloadable files

Nothing on this Site may be copied, reproduced, distributed, modified, referenced for commercial use, or used to create derivative works without express written permission.

You may not claim ownership of, or authorship over, any content from this Site.

All rights reserved under U.S. and international copyright law.

3. Absolutely No AI Training, Data Scraping, or Machine Learning Use

You do not have permission to use any content from this Site for:

  • training artificial intelligence models

  • machine learning datasets

  • neural networks

  • image generators

  • diffusion models

  • dataset building

  • scraping for “style analysis”

  • using my artwork as prompts, seeds, or source material

  • any automated or manual ingestion into AI systems

This prohibition applies to:

  • humans

  • bots

  • crawlers

  • scrapers

  • aggregators

  • any third-party software

  • any manual or automated process designed to collect data for machine learning

You are prohibited from:

  • downloading

  • screenshotting

  • copying

  • scraping

  • saving

  • ingesting

  • re-uploading

  • storing

  • or supplying

any content from this Site for the purpose of building, assisting, training, or refining AI systems.

Violation of this clause constitutes copyright infringement, breach of contract, and may lead to civil action, including injunctive relief and damages.

4. Permitted Personal Use

You may view and browse this Site for personal, non-commercial purposes only.

Unless explicitly stated otherwise, you may not:

  • download images

  • save images for reuse

  • repost images

  • edit or crop images

  • remove watermarks

  • upload images to other platforms

  • use images in mood boards or concept decks

  • share images with designers or third parties without credit

5. Derivative Works & Reference Use

You may not create derivative works, sketches, paintings, 3D models, or digital renders based on artwork from this Site for commercial use, contests, exhibitions, or resale.

Personal study/reference use is permitted only when:

  • the final posted work includes clear credit:
    “Reference image: Ava Bock Art (avabock.art)”

  • you do not sell, license, print, or otherwise commercialize the derivative work

The artist reserves the right to remove or revoke reference permission at any time.

6. Digital Products (If Offered)

Digital downloads are licensed, not sold.

You receive a personal, non-commercial, non-transferable, revocable license to use the file only in the ways stated at purchase.

You may NOT:

  • resell

  • share

  • upload

  • redistribute

  • print for sale

  • claim as your own

  • use in NFTs

  • use in AI systems

  • store in shared drive folders

  • distribute modified versions

Any violation terminates the license immediately.

7. Purchasing & Payments

All prices are in USD unless stated otherwise.

By placing an order, you agree to:

  • provide accurate information

  • ensure payment method is valid

  • ensure your shipping address is secure

Orders may be canceled by us if we suspect fraud or misuse.

8. Shipping, Returns, and Refunds

Shipping and return terms are described in:

Those terms are part of this Agreement.

9. Accuracy of Information

We make every effort to display accurate descriptions, colors, and details.
Because artwork is handmade and materials vary, slight variations are normal and not considered defects.

10. Prohibited Uses

You may not use this Site or its content for:

  • unlawful or fraudulent activity

  • copying or redistributing content

  • harassment, defamation, or harm

  • scraping, crawling, or data mining

  • AI training or dataset creation

  • reproducing artwork without permission

  • reverse engineering or bypassing security measures

  • interfering with Site functionality

Any misuse may result in termination of access and legal action.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Ava Bock Art is not liable for any indirect, incidental, or consequential damages.

  • We are not liable for loss due to carrier shipping errors, delays, or theft unless covered by Route Package Protection.

Use this Site at your own discretion and risk.

12. Dispute Resolution (Mediation → Arbitration → Court)

If a dispute arises, we agree to pursue the following steps in order:

1. Mediation

Both parties will first attempt to resolve disputes through non-binding mediation.

2. Arbitration

If mediation fails, disputes will be resolved through binding arbitration in Oregon under the rules of the American Arbitration Association (AAA).

3. Court

If arbitration is not permitted by law or is unenforceable, claims may be brought to a court of competent jurisdiction in Oregon, USA.

You waive the right to a jury trial, to participate in class actions, or to seek punitive damages beyond what is allowed by law.

13. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.

14. Changes to These Terms

We may update these Terms occasionally. Continued use of the Site means you accept any revised Terms.
